Where is the question here? Isn't that what a question mark is for?
I guess if you're the news, then a question mark takes away you're responsibility to actually explain what you're reporting (see: Fox News "terrorist fist jab?")

If you were to bother to read the NYTimes artical, There was very much confusion as to who fired at who first. So the question mark would indicate confusion. Sorry, I didn't realize you wer a punctuation nazi. My bad.
